Terms of use of the Site :

Website access

Access to the Site is open to all Internet users and mobile users, natural persons of any kind, aged at least sixteen (16) years, provided that they have an Internet connection. However, the creation of a customer account is necessary if the Internet user or mobile user wishes to place an order on the Site. In this case, the Company invites you to refer to the General Terms and Conditions of Sale.

By surfing on the Website, the Internet user or mobile user acknowledges that he/she has read and accepts these Terms and Conditions of Use fully and unreservedly.

Identifying the Customer 

For any initial order, the Customer must follow the procedure for creating a customer account, as indicated on the Site. To place an order, the Customer must identify him/herself with his/her email address and password.

In the event of loss or omission of the password, the Customer may re-apply for it by accessing their customer account and clicking on « Forgotten password ». They will then receive a link to change their password at the email address they provided when creating their customer account.

Ordering

Customers must be at least eighteen (18) years of age and have the legal capacity necessary to place and honour any order or be the holder of an authorisation allowing them to place and honour any order and be able to justify this at any time, at the Company’s request.

The Customer places his/her order on the Site in accordance with the procedure set out and explained below:

Customers enter the Site address: www.lateliergrosdesirs.fr 

Customers select the Products they wish to order and add them to their basket,

Customers complete the account creation form (for the first order) or log in to their customer account,

Customers fill in and check the details relating to their order: the delivery and invoicing address [failing which the order will be rejected, Customers must choose a delivery address for the Product(s) that is/are located in the countries referred to in article 8.1 of the General Terms and Conditions of Sale], the delivery method chosen, the payment method chosen and the bank details required for payment,

Customers check and expressly accept the General Terms and Conditions of Sale and the Privacy Policy,

Customers confirm the order, the total price and the all-inclusive price by clicking on « Pay my order »,

Customers receive an electronic acknowledgement of receipt containing the details of their order. The order will only be confirmed once payment has been accepted by Customer’s bank and the amount of the order has been received by the Company,

Customers will receive an electronic confirmation of their order,

Customers receive their parcel at the delivery address they indicated when placing their order,

A summary of the order will also be available on the Site in the « My Account » section, « My Orders » category.

Orders are only validated once payment has been accepted. Once payment has been received, an order confirmation will be sent by the Company to the Customer, by e-mail to the e-mail address indicated by the Customer.

Customers accept the invoice as proof of the contractual relationship between the parties. The Customer may print the invoice sent with the order confirmation.

In compliance with article 1127-2 of the French Civil Code concerning the conclusion of a contract in electronic form, the Customer may view the details of his order (Product, reference, quantity, unit price) and its total price, and correct any errors. Customers must check the accuracy of their order before confirming it to express their acceptance. Any confirmed order implies acceptance of the prices and descriptions of the Products available for sale. Any dispute on this point will be settled within the framework of a possible exchange and the guarantees mentioned in article 10 of the General Terms and Conditions of Sale. The Company will acknowledge receipt of the order by e-mail as soon as it has been placed.

If a product is unavailable at the time the order is placed, the customer will be informed by e-mail to the e-mail address provided when the customer account was created.

Under certain circumstances, notably non-payment, incorrect address or other problem with the customer account, the Company reserves the right to block the customer’s order until the problem has been resolved.

For any questions relating to the tracking of an order, the Customer should either consult his customer account on the Site, or write to Customer Service, whose contact details are given above.

In the event of a dispute over a previous order, or if the Company reasonably believes that the Customer has breached the General Terms and Conditions of Sale, has engaged in fraudulent activity, or for any other legitimate reason, the Company reserves the right not to accept an order.

Payment

Payment is in euros, by credit card (Carte Bleue, Visa, Mastercard or American Express)

To guarantee payment security, the Site uses the secure payment gateway Stripe. This service incorporates the SSL security standard. Confidential data (16-digit credit card number, expiry date and CVV/CVC code) are transmitted encrypted directly to the bank’s server, without passing through the physical medium of the Company’s server. When the order is validated: The payment request is routed in real time to the secure telepayment manager. The latter sends an authorization request to the bank card network. The telepayment manager issues an electronic certificate, which serves as proof of the amount and date of the transaction, in accordance with the provisions of articles 1358 et seq. of the French Civil Code.

Property rights

The Company holds the right to market all Products on the Site.

All the elements contained on the Site, whether visual or audio, including the underlying technology, trademarks, logos, graphics, photographs, drawings and models, are protected by copyright, trademarks, patents or any other intellectual property right. They are the exclusive property of the Company. Their disclosure shall in no way be interpreted as granting a license or right to use said trademarks and distinctive elements protected by copyright. They may not be used under penalty of prosecution.

Accordingly, none of the documents originating from the Site may be copied, reproduced, republished, downloaded, posted, transmitted or distributed in any way whatsoever, without the prior authorization of the Company.

It is however possible for the Internet user or mobinaute to download a copy of the documents onto a computer for his/her personal use and for non-commercial purposes only, provided that the information contained therein is not modified and that all copyrights and other proprietary notices are kept intact. Modification of these documents or their use for any other purpose constitutes an infringement of the Company’s intellectual property rights. Similarly, any hypertext link to the Site using the framing or in-line linking technique is strictly prohibited.

Disclaimer

The Company is committed to ensuring the proper operation of the Site. However, it cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses.

The Website conforms to French law, and in no case does the Company give any guarantee of conformity to local legislation that may be applicable to the Internet user or mobinaute, when accessing the Website from other countries.
